Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your use of Pixel Genie ("the Service", "we", "us"), available at pixelgenie.app. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or 16 in the EEA) to use the Service. By using the Service you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3. Account
You are responsible for the security of your account and for all activity that occurs under it. Use a strong, unique password and notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for abuse, fraud, or unlawful activity.
4. Tokens, plans, and payments
The Service uses a token-based system for AI image and video generation. Tokens may be granted on signup, included in subscription plans, or purchased separately. Payments are processed by Stripe; by purchasing tokens or a subscription you also agree to Stripe's terms.
Subscriptions renew automatically until cancelled. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period. Except as required by law, payments and tokens are non-refundable.
Prices may change with reasonable notice. Tokens have no cash value, cannot be transferred between accounts, and may expire if your account is terminated.
5. Acceptable use
You agree not to use the Service to generate, upload, or distribute content that:
- Is unlawful, defamatory, or violates the rights of others (including IP, privacy, or publicity rights).
- Sexually exploits or endangers minors (CSAM is strictly prohibited and reported).
- Depicts real, identifiable people in explicit, defamatory, or harassing contexts without consent.
- Promotes violence, terrorism, self-harm, or illegal activity.
- Is intended to deceive, defraud, or impersonate (including for political disinformation).
- Contains malware, attempts to compromise the Service, or abuses our infrastructure.
- Circumvents rate limits, token costs, or access controls.
We may remove content and suspend accounts that violate this section, and may report unlawful content to authorities.
6. Your content and ownership of output
You own the images you generate. Subject to your compliance with these Terms, we assign to you all of our right, title, and interest (if any) in the images you generate using the Service ("Your Output"). You may use Your Output for any lawful purpose, including personal, commercial, and for-profit use — sell prints, use them in games, ship them in products, whatever. We do not claim any ownership of Your Output and we do not require attribution.
Important limit: ownership of an image you generate does not give you rights to underlying material that belongs to someone else. If you prompt the model to reproduce a copyrighted character, a trademarked logo, a real person's likeness, or other protected material, you remain responsible for obtaining any rights needed to use that material. We don't grant you those rights, and we won't defend you if a rights-holder makes a claim. When in doubt, don't use prompts that target a specific copyrighted or trademarked work.
You also retain ownership of the prompts you submit ("Your Inputs"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display Your Inputs and Your Output solely for the purpose of operating the Service (including transmitting them to the AI providers you select for generation). If you submit Your Output to a public gallery, profile, or share feature, you grant us and other users a license to view and display it within the Service; you can remove public submissions at any time.
7. AI-generated output — practical notes
AI models are produced by third-party providers and can be unpredictable. You are responsible for evaluating any generation before you rely on it. Similar prompts may produce similar results across users, and the legal status of AI-generated content (including copyright eligibility in some jurisdictions) continues to evolve. We make no warranty that Your Output is unique, original, eligible for copyright protection, or free of third-party claims — see Section 11 for the full disclaimer.
8. Our content
The Service itself — including software, branding, UI, palettes, presets, and documentation — is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works of the Service except as expressly permitted.
9. Third-party services
The Service depends on third-party providers (Stripe, AI model APIs, hosting, email, etc.). We are not responsible for their availability or actions, and your use of those services may be subject to their own terms.
10. Termination
You may delete your account at any time from your settings. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination your right to use the Service ends immediately; provisions that by their nature should survive (including IP, disclaimers, and limitation of liability) will survive.
11. Disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all such warranties.
12. Limitation of liability
To the fullest extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) USD 50.
13. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.
14. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction in those courts, except where prohibited by your local law.
15. Changes
We may update these Terms from time to time. Material changes will be announced by email or by a prominent notice in the Service. Continued use of the Service after the effective date of an update constitutes acceptance of the updated Terms.
